Terms of Service

These Terms of Service ("Terms") govern your use of the Surgo app and related services (the "App" or "Surgo"), operated by Surgo Digital Labs Ltd (registration no. HE 492201), Paphos, Cyprus ("Surgo", "we", "us", or "our"). By creating an account or using Surgo, you agree to these Terms. If you don't agree, please don't use the App.

These Terms work together with our Privacy Policy, which explains how we handle your personal data and forms part of your agreement with us. Please read it at https://surgolbs.com/privacy.

1. Eligibility

You must be at least 13 years old to use Surgo, or older if the law of your country sets a higher minimum age for using an app like Surgo or for consenting to the processing of your personal data. If you are under 18 (or the age of majority where you live), you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf and consents to your use of the App.

By using the App you confirm that you meet these requirements and that the information you provide is accurate and kept up to date.

2. Your account

Sign-in is handled by Apple or Google. You are responsible for all activity that takes place under your account and for keeping your sign-in method secure. You agree to notify us promptly at support@surgolbs.com if you believe your account has been accessed without your permission.

You may delete your account at any time from within the App. Deleting your account is handled as described in our Privacy Policy.

We may investigate suspected violations and may suspend or terminate accounts that breach these Terms, including removing scores, rankings, coins, or content obtained unfairly or in violation of these Terms.

4. User content

You retain ownership of the content you submit, such as images, usernames, and group details ("User Content"). You grant Surgo a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and process your User Content solely to operate, secure, and improve the App and its features. This license ends when you delete the relevant User Content or your account, except for content that has been shared with others or that we must retain to comply with law, resolve disputes, or enforce these Terms, and except for residual copies held in secure backups for a limited period.

You are responsible for your User Content and confirm you have the rights necessary to submit it and to grant the license above. Uploaded images are automatically screened for unsafe content before they are published, and we may remove or restrict any content that violates these Terms or that we reasonably consider harmful.

Reporting content. If you believe content in the App is offensive, infringes your rights (including copyright), or otherwise breaches these Terms, please report it to us at support@surgolbs.com with enough detail to identify the content, and we will review it.

Feedback. If you send us suggestions or feedback about the App, you agree we may use them without restriction or obligation to you.

5. Groups and competition

Groups, leaderboards, coins, boosts, streaks, and rewards are features of a game layer within the App. Coins and other virtual items are earned through gameplay only; they cannot be purchased, have no monetary value, are not your property, and cannot be exchanged, transferred, or redeemed for cash or anything of value outside the App.

Because they are part of a game, virtual items, scores, and rankings may be adjusted, recalculated, reset, or removed as part of normal gameplay and app operation — for example, weekly leaderboard resets, correcting errors, or responding to cheating or abuse.

6. Purchases and subscriptions

Surgo may offer auto-renewing subscriptions. Subscriptions and any other in-app purchases are sold and processed by Apple under Apple's terms; Apple is the merchant of record. Prices and features are shown in the App at the time of purchase.

Subscriptions renew automatically for the same period unless you cancel at least 24 hours before the current period ends. You can manage or cancel a subscription at any time in your Apple account settings; deleting the App alone does not cancel a subscription.

Except where required by law, purchases are non-refundable, and refund requests are handled by Apple in accordance with Apple's policies. Nothing in this section limits any statutory right of withdrawal, cancellation, or refund you may have as a consumer under the law of your country of residence.

7. Health and safety disclaimer

Surgo is a fitness and entertainment product. It is not a medical device and does not provide medical advice, diagnosis, or treatment. The scores, metrics, and insights it provides (including AI-generated insights) are for general informational and motivational purposes only.

Always consult a qualified professional before starting, changing, or intensifying any training, exercise, or health routine. Swimming and other physical activity carry inherent risks; you participate at your own risk and are responsible for exercising appropriate caution and stopping if you feel unwell. Do not rely on Surgo for any decision that could affect your health or safety.

8. Third-party services

The App relies on third-party services, including Apple, Google, Supabase, OpenAI, RevenueCat, and others described in our Privacy Policy. Your use of features that depend on those services may also be subject to their own terms, and their processing of your personal data is described in our Privacy Policy. We are not responsible for third-party services we do not control.

9. App store terms

You obtain Surgo through the Apple App Store or Google Play, and your use is also subject to the applicable store's terms. The following additional terms apply.

Apple. You acknowledge that these Terms are between you and Surgo only, and not with Apple Inc. ("Apple"), and that Apple is not responsible for the App or its content. Your license to use the App is limited to a non-transferable license to use it on any Apple-branded device that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. Apple has no obligation to provide any maintenance or support for the App. Apple is not responsible for any product warranties, whether express or implied; in the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App, and to the maximum extent permitted by law Apple will have no other warranty obligation with respect to the App. Surgo, not Apple, is responsible for addressing any claims relating to the App or your use of it, including product liability claims, claims that the App fails to conform to legal or regulatory requirements, claims under consumer protection or similar laws, and intellectual property claims. In the event of any third-party claim that the App or your use of it infringes that party's intellectual property rights, Surgo, not Apple, is responsible for the investigation, defense, settlement, and discharge of such claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, will have the right to enforce these Terms against you as a third-party beneficiary.

Google. If you obtain the App through Google Play, you agree to comply with the Google Play Terms of Service, and you acknowledge that Google is not a party to these Terms and is not responsible for the App.

10. Privacy

Your privacy matters to us. Our Privacy Policy explains what personal data we collect, how we use it, who we share it with, and the rights and choices you have, including how we handle health and fitness data. By using Surgo you acknowledge that we process your personal data as described in the Privacy Policy at https://surgolbs.com/privacy.

11. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, timely, secure, or error-free, or that scores, rankings, metrics, or insights will always be accurate or complete. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

12. Limitation of liability

To the maximum extent permitted by law, Surgo and its directors, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, goodwill, or opportunity, arising from or relating to your use of, or inability to use, the App.

To the maximum extent permitted by law, our total aggregate liability for all claims arising from or relating to the App or these Terms will not exceed the greater of (a) the total amount you paid, if any, for Surgo in the 12 months before the event giving rise to the liability, or (b) EUR 50.

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any liability that cannot be excluded or limited under applicable law. If you are a consumer, these Terms do not affect your mandatory statutory rights.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Surgo and its directors, employees, and suppliers from and against any claims, damages, losses, liabilities, and reasonable expenses (including legal fees) arising out of or relating to your User Content, your misuse of the App, or your breach of these Terms or of any applicable law or the rights of any third party. This section does not apply to the extent a claim results from our own breach of these Terms or our negligence, and does not limit your mandatory rights as a consumer.

14. Termination

You may stop using Surgo and delete your account at any time. We may suspend or terminate your access if you materially or repeatedly breach these Terms, if required by law, or if we discontinue the App. Where reasonable and lawful to do so, we will aim to give you notice.

On termination, your right to use the App ends. Sections that by their nature should survive termination — including User Content licenses already granted, disclaimers, limitation of liability, indemnity, and governing law — will continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, for material changes, notify you in the App or by email. Changes take effect when posted, or on any later date we specify. Your continued use of Surgo after changes take effect means you accept the updated Terms; if you do not agree, you should stop using the App and may delete your account.

16. Governing law and disputes

These Terms are governed by the laws of the Republic of Cyprus. The courts of Cyprus have exclusive jurisdiction over any dispute arising from or relating to these Terms or your use of Surgo. This does not affect any mandatory rights you have — including the right to bring proceedings in the courts of, and under the consumer-protection law of, your country of residence — where the law of that country gives you those rights.

17. General

These Terms, together with the Privacy Policy, are the entire agreement between you and Surgo regarding the App and replace any prior agreements on that subject. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect, and the unenforceable provision will be applied to the fullest extent permitted by law. Our failure to enforce any provision is not a waiver of our right to do so later. You may not assign or transfer these Terms without our consent; we may assign them to an affiliate or in connection with a merger, acquisition, or sale of assets. We are not liable for any failure or delay caused by events beyond our reasonable control.
